General terms and conditions for participation in Voshaar competitions and events.
Article 1 Definitions In these general terms and conditions the following terms shall have the following meanings:
- a) Organizer: .
- b) Event: The events / competitions organized by the Organizer or under the auspices of the Organizer.
- c) Participant: the natural person, not acting as an entrepreneur, who has registered to participate in the Event in a manner permitted by the Organizer.
- d) Agreement: the agreement for the Participant's participation in the Event.
These general terms and conditions apply to every Agreement.
Article 2 Participation
- Participation in the Event is only possible for a natural person who meets the requirements set by the Organizer.
- The Participant may only participate in the Event if he has completed the registration form for this purpose in full and truthfully, if the registration fee has been paid in full and if the participant has agreed to the general terms and conditions. The Organizer reserves the right to delete registrations with incorrectly filled in personal data at any time.
- Registration and participation in the Event is personal and non-transferable.
- After registration, the registration fee cannot be refunded.
- Upon registration, the Participant undertakes to pay the registration fee including any ordered extras, regardless of actual participation.
- All 'rejected' Participant(s) will receive their registration fee back after registration closes.
- If the Event cannot take place due to exceptional circumstances, the registration fee will be refunded.
- The Organizer or a competent authority may decide to terminate, suspend or neutralize the Event prematurely on the basis of exceptional circumstances. The Organizer or a competent authority may also decide to move, advance or abandon parts or even cancel them on the basis of exceptional circumstances. In such cases, no refund of the registration fee will take place.
Article 3 Liability
- Participation is at your own risk. The Organizer is not liable for any damage, of whatever nature, that the Participant may suffer as a result of participation, unless this damage is the direct result of intent or gross negligence attributable to the Organizer. This exclusion of liability also applies to serious types of damage such as all possible types of damage resulting from injury or death.
- If, despite the provisions of the first paragraph of this article, the Organizer is liable for damage suffered by the Participant, the Organizer's obligation to compensate for such damage shall be limited to a maximum of the amount paid out by the Organizer's insurer in respect of such damage.
- The Participant must be adequately insured against the risk of damage that he or a surviving relative may suffer as a result of his death, injury or illness caused by his participation in the Event.
- The Participant declares that he/she is aware of the fact that participation requires good health in both a mental and physical sense, and declares that he/she meets this requirement and that he/she will have prepared himself/herself sufficiently for the Event through training and otherwise. The Organizer expressly and urgently advises the Participant to undergo a sports medical examination in connection with participation in a competition.
- The Participant shall indemnify the Organizer against any damage that third parties may suffer as a result of an act or omission attributable to the Participant with regard to the Event. The Participant must be adequately insured against the risk of liability for such damage.
- Sponsors of the Event in which the Event takes place are excluded from liability.
Article 4 Portrait rights
Participant grants permission in advance to the Organizer and its partners for the publication of photos and images and the like taken during or around the Event, in which the Participant is visible. The Organizer is not liable to pay compensation to the Participant in this regard.
Article 5 Personal data
The personal data provided by the Participant will be included in a file by the Organizer. By entering into the Agreement, the Participant grants permission to the Organizer to use the personal data for sending information to the Participant and for providing the personal data to the Organizer for the purpose of sending information to the Participant. The Participant is permitted at all times, free of charge, in writing or by e-mail, to object to the sending of information by the Organizer or to the provision of personal data, after which the Organizer will stop sending or providing such data. By entering into the Agreement, the Participant grants permission to the Organizer to publish his name and competition results, for example by means of publication via the internet and other media.
Article 6 Competition Rules (Competitions)
By participating in the Event, the Participant agrees to the applicability of the competition rules and any competition provisions. The aforementioned rules and provisions form an integral part of these general terms and conditions.
Article 7 Validity of provisions
If one or more articles of these terms and conditions are void or unlawful for any reason, this will not affect the validity of the other parts of the terms and conditions.
